1 Introduction

This Privacy Policy ("Policy") explains how Kahunas FZE ("Kahunas", "we", "us", or "our") collects, uses, shares, and protects personal information through our websites, mobile and desktop applications, and services (collectively, the "Services"). Kahunas is incorporated in the United Arab Emirates, with its registered office at Coworking Business Centre, Sharjah Publishing City Free Zone, Sharjah, UAE.

We serve users globally. While our infrastructure is hosted primarily in the United Kingdom, with certain sub-processors located in the United States and other jurisdictions, this Policy applies to all users regardless of location. This Policy is incorporated into the Kahunas Business User Terms by reference and should be read together with them.

2 Scope and Application

This Policy applies to all individuals who interact with our Services, including coaches, clients, and site visitors. Our Services are not directed at children under 16. By accessing or using the Services, you acknowledge the practices described in this Policy.

3 Our Role: Controller and Processor

Kahunas operates under different roles depending on context:

  • Data Controller: When we collect and process personal data for our own purposes — including account management, platform analytics, product improvement, and marketing communications — Kahunas acts as the data controller.
  • Data Processor: When coaches use our platform to manage their clients' personal data (fitness records, coaching notes, communications), Kahunas acts as a data processor on behalf of the coach, who is the data controller. We maintain Data Processing Agreements (DPAs) for this purpose.

Coaches are responsible for ensuring they have appropriate legal grounds and disclosures in place when using our platform with their clients. We provide DPA templates and guidance to support compliance.

11 AI Training and Automated Processing

AI Training.

We use AI and machine learning to enhance our Services, including improving coaching recommendations, personalising user experiences, and developing new features. For AI training purposes:

  • We use only properly anonymised data that cannot be re-identified
  • Health and special category data requires explicit, separate consent before use in AI training
  • You may opt out of AI training at any time via account settings or by contacting compliance@kahunas.io
  • Opting out of AI training does not affect your access to our Services
  • We maintain records of AI training activities and data categories used

Your Rights Regarding Automated Processing.

We do not make decisions with legal or significant effects on you based solely on automated processing. Where automated systems are used for personalisation or recommendations, you may request human review, understand the logic applied, and contest or request reconsideration of any output.

12 Automated Health Scores

We use automated algorithms to generate numerical health scores (0–100 scale) from your health data:

  • Sleep Score: Based on sleep duration, deep sleep phases, and REM sleep quality
  • Stress Score: Derived from heart rate variability, resting heart rate, and blood pressure
  • Anxiety Score: Combination of stress indicators and sleep quality metrics
  • Readiness Score: Sleep quality, HRV, and activity levels for training preparation
  • Wellbeing Score: Daily steps, sleep patterns, and cardiovascular health indicators

These scores are informational aids to support coaching. They do not constitute medical diagnoses or treatment decisions. You have the right to understand how scores are calculated, access the underlying raw data, discuss interpretations with your coach, and opt out of automated scoring while retaining access to raw health data.

13 Your Data Protection Rights

Depending on your jurisdiction, you have the following rights. To exercise any right, contact us at compliance@kahunas.io.

A client who was already archived when this version took effect is deleted 12 months after their original date of archiving, but no earlier than 90 days after the effective date of this version. Before the 12 months end, a coach may request an export of the client's data; the export is sent only to the client. We notify the coach and the client 30 days before an archived client's data is deleted. Records required for financial and tax compliance may be retained for up to 7 years, with personal data limited to what is necessary for the relevant legal, accounting or regulatory purpose. A minimal internal record evidencing that deletion took place is retained for 6 years. Operational deletion timelines are set out in the Kahunas Data Retention Policy.

2.021 August 2025Updated to cover the collection and processing of special category health and fitness data, including consent requirements and automated health scores.
3.01 July 2026Aligned structure and formatting with the Business User Terms. Added Scope and Application (Section 2), Third-Party Data Sources (Section 6), and UAE Data Protection (Section 22). Expanded AI training and automated processing sections. Synchronised the sub-processor list (Section 10) with the Kahunas Sub-Processor List v1.1: added Vercel AI Gateway, PayPal, SigNoz, OpenReplay, Cerebras, and Groq; removed Anthropic; and reclassified YouTube/Vimeo as user-authorised integrations. Clarified data security measures in Section 16. Added Appendix A (Version History).
3.117 August 2026Synchronised the sub-processor list (Section 10) with the Kahunas Sub-Processor List v2.1: added Cloudflare (Turnstile), GIPHY, and Typesense; added Vercel Analytics and Vercel Speed Insights; added Apple (App Store In-App Purchase); added DeepSeek, the AI assistant's default inference model routed via Vercel AI Gateway. Removed location data from automatically collected data (Section 4A). Clarified in Section 9 that data shared with "your assigned coach" also extends to authorised team members/staff at the coach's business, reflecting the platform's team-member client-access feature.
3.231 August 2026Synchronised the sub-processor list (Section 10) with the Kahunas Sub-Processor List v2.2: broadened the GetStream entry to cover Communities (group posts, comments, and reactions on Stream Activity Feeds), alongside its existing coach–client chat use. Added a new sharing category to Section 9 for other members of a Community you join, and updated the corresponding data-collected list in Section 4.
3.323 September 2026Section 14 (Data Retention): clarified that the stated periods are maximums and that, in practice, personal and coaching data is deleted within 30 days of account closure or offboarding; financial and tax compliance records are retained for up to 7 years with personal data limited to what is necessary for the relevant purpose; and a minimal deletion-evidence record is retained for 6 years. Cross-referenced the Kahunas Data Retention Policy. No maximum retention period was changed.
3.428 September 2026Synchronised the sub-processor list (Section 10) with the Kahunas Sub-Processor List v2.3: added OpenAI, used (via Vercel AI Gateway) to transcribe voice notes in coach–client messaging, and added OpenAI to the AI providers named under "AI Providers and Health Data".
3.529 September 2026Section 14 (Data Retention): aligned retention periods with actual platform practice and the Kahunas Data Retention Policy. Account data reduced from active account plus 3 years to active account plus 30 days; Health data reduced from active account plus up to 3 years to active account plus 30 days (or until consent is withdrawn, whichever occurs first); System logs changed from 12 months to up to 90 days depending on the system; Chat messages changed from 3 years (or until account deletion is requested) to the duration of the active account plus 30 days; Support messages reduced from 3 years to 1 year from ticket closure. Added a retention period for consent and legal-acceptance records (duration of the account plus 6 years). Replaced "Marketing preferences: 2 years after opt-out" with separate periods for marketing consent and opt-out records (duration of the account plus 6 years, or 6 years from opt-out for subscribers without an account), the marketing suppression list (kept for as long as marketing is sent), and other marketing data (deleted within 30 days of opt-out).
3.630 September 2026Section 15 (International Data Transfers): clarified that transfers to US-based sub-processors are protected by Standard Contractual Clauses or another approved transfer mechanism, such as the EU–US Data Privacy Framework (and UK Extension) where the sub-processor is certified, rather than stating that SCCs are in place with every US-based sub-processor. Sections 2 and 15: corrected the hosting statement to say infrastructure is hosted primarily in the United Kingdom (application hosting, primary database, and media storage are in London), with certain sub-processors in the United States and other jurisdictions, consistent with the Data Processing Addendum and Security Overview. Section 10: synchronised the sub-processor table with the Kahunas Sub-Processor List v2.4 — corrected the processing regions for GetStream (Chat in the United States; Communities in the European Union), Typesense (United Kingdom, Australia, and India), and SigNoz and OpenReplay (both self-hosted on AWS in the United Kingdom).
3.72 October 2026Section 10: synchronised the sub-processor table with the Kahunas Sub-Processor List v2.5 — the DeepSeek model is served by Baseten (United States), and the Upstash region is corrected to United Kingdom (London). Named Baseten in the AI providers statement.
3.85 October 2026Section 5: added laboratory test results (lab reports a client uploads and the results read from them) and reproductive health (menstrual cycle data, where the user chooses to record it) to the health and fitness data we may collect with explicit consent. Section 10: synchronised the sub-processor table with the Kahunas Sub-Processor List v2.6 — added Cartesia (text-to-speech for optional voice recaps of AI agent results) and SerpApi (web search for the AI research agent, using coach-entered topics only) — and named Cartesia in the AI providers statement.
3.96 October 2026Section 14 (Data Retention): added that where a coach archives a client, the client's personal, coaching and health data is kept for up to 12 months from the date of archiving and is then deleted, unless the coach restores the client before then. Clients already archived are deleted 12 months after their original date of archiving, but no earlier than 90 days after the effective date of this version. The coach and the client are notified 30 days before deletion.
